Patricia Kay Dube, a former claims adjuster with an electric utility company, has 38 years of experience in handling general civil complex litigation in federal and states courts and arbitration proceedings in areas that include commercial litigation, products liability, construction defect, professional malpractice (including employment), complex mass tort and pharmaceutical litigation involving antidepressants and the arthritic pain medication Bextra and Celebrex, as well as retailers and suppliers of herbal and diet substitutes, medical malpractice and healthcare, privilege issues inclusive of medical peer and credentialing committees, oil field, maritime and transportation, defamation (including Anti-Slapp), insurance disputes, extracontractual and subrogation litigation. Her practice includes handling of excess and reinsurance matters, negotiation of insurance contracts and manuscript provisions, negotiating complex cost sharing agreements, and related insurance matters on a domestic and international basis. She has represented foreign underwriters in evaluation and supervision of product liability claims of recognized international corporations throughout the world.

 

Patricia Kay Dube is a native Texan, born in Houston and raised in a small German – Czech community southwest of Houston. Ms. Dube received a Bachelor of Science Degree from the University of Texas at Austin in 1972, a Master of Arts Degree from Sam Houston University in 1973 with a thesis on Latin America Political and Economic Development. She earned her J. D. from South Texas College of Law in 1979, where she was assistant editor of Law Review, achieved Order of the Lytae, and graduated with honors.

 

Ms. Dube currently practices throughout the state of Texas out of the the Firm’s office in Dallas, Texas and affiliate office in Houston, Texas with residences in both cities.

SAMPLING OF CAREER HIGHLIGHTS

 

Ms. Dube successfully obtained temporary restraining orders against an entire hospital physician staff and secured the voluntarily agreements of physicians to enter into an agreed permanent injunction regarding nondisclosure of medical peer review communications.  This action thwarted the ability of counsel for Plaintiffs in a number of serious medical malpractice cases from obtaining evidence that would support a new medical malpractice cause of action in Texas courts regarding negligent credentialing. Related discovery actions resulted in counsel for Plaintiffs mandamusing the trial judge. The Appellate Court’s affirmed the Trial Court and the mandamuses have been dismissed. The Texas Supreme Court affirmed.

 

Ms. Dube secured a $6.0 million judgment in a declaratory judgment action involving some of the largest domestic insurance carriers in connection with complex coverage issues relating to a Directors and Officers Policy of Insurance.

 

Fundamentally responsible for the development of the domestic insurance defense/self-insured litigation and complex insurance coverage practice of the Houston office of a New York law firm that was an all service firm as respects the insurance industry on a domestic and international basis, including corporate and regulatory matters, winding down and/or creating of insurance companies, reinsurance matters, and broad range litigation and coverage matters.

 

Former Licensed Claims Adjuster for one of the most prominent and largest electric utilities in the State of Texas.  The utility investigated, evaluated, and handled personal injury, product, and property claims asserted against a self-insured entity, and liaised with outside counsel in coordination of defense of litigation; Work with Company Insurance Risk Manager as respects company claims and insurances.
